These Terms of Service ("Terms") govern your use of shopbestest.com and related pages (the "Site"), operated by Bestest Automotive LLC ("Bestest," "we," "us"). By using the Site, you agree to these Terms. If you don't agree, don't use the Site.
Bestest is a curated used-car marketplace and information service. We highlight a hand-vetted subset of used-vehicle listings and help connect interested shoppers with the dealers that hold them.
Bestest is not a car dealer, broker, lender, or party to any vehicle sale or financing. We don't own, sell, finance, or deliver vehicles, and we don't take part in or guarantee any transaction between you and a dealer. Any purchase, financing, trade-in, or other dealing is solely between you and the dealer.
Listing details (price, mileage, features, photos, availability) come from third parties, including dealers and data providers, and may be inaccurate, incomplete, out of date, or no longer available (for example, a vehicle may already be sold). We don't guarantee any listing information. Always confirm details, price, condition, and availability directly with the dealer before relying on them.
Our editorial content — including recommendations and write-ups — reflects our opinions for general informational purposes. It is not financial, legal, or professional advice, and not a guarantee about any vehicle. Do your own diligence (including inspections and vehicle-history checks) before buying.
When you submit the "Check availability" form, you authorize us to share your inquiry with the selected dealer (and its agents) and to relay it on your behalf, and you consent to be contacted as described in our Privacy Policy, including by phone and text (potentially automated) if you provide your number. That consent is not a condition of any purchase, and you can opt out at any time.
You agree not to: use the Site unlawfully or for any unlawful purpose; scrape, harvest, or bulk-download Site content except as expressly permitted; interfere with or disrupt the Site; misrepresent your identity or submit another person's information without authorization; or attempt to access areas or data you're not authorized to access.
The Site and its content — including text, editorial, design, logos, and the "Bestest" name and marks — are owned by Bestest or its licensors and protected by law. We grant you a limited, revocable, non-exclusive license to use the Site for your personal, non-commercial vehicle shopping. Listing data and dealer/manufacturer marks belong to their respective owners.
If you believe content on the Site infringes your copyright or other intellectual-property rights, email hello@shopbestest.com with a description of the work, the location (URL) of the material, and your contact information, and we'll review and remove infringing material as appropriate.
The Site links to dealer websites and other third-party services. We don't control and aren't responsible for their content, products, practices, or availability. Your dealings with any third party are solely between you and them.
THE SITE AND ALL CONTENT ARE PROVIDED "AS IS" AND "AS AVAILABLE," WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT, AND ANY WARRANTY THAT LISTING INFORMATION IS ACCURATE, CURRENT, OR COMPLETE. We don't warrant that the Site will be uninterrupted, secure, or error-free.
TO THE FULLEST EXTENT PERMITTED BY LAW, BESTEST AND ITS OWNERS, EMPLOYEES, AND SUPPLIERS WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF DATA, PROFITS, OR GOODWILL, ARISING FROM OR RELATED TO YOUR USE OF THE SITE, ANY LISTING, OR ANY DEALER OR TRANSACTION — EVEN IF ADVISED OF THE POSSIBILITY. OUR TOTAL LIABILITY FOR ANY CLAIM RELATING TO THE SITE WILL NOT EXCEED ONE HUNDRED U.S. DOLLARS ($100). Some jurisdictions don't allow certain limitations, so some of these may not apply to you.
You agree to indemnify and hold harmless Bestest and its owners and employees from any claims, losses, and expenses (including reasonable legal fees) arising from your use of the Site, your violation of these Terms, or your violation of any law or third-party right.
These Terms are governed by the laws of the State of California, without regard to conflict-of-laws rules. You agree that the state and federal courts located in Orange County, California have exclusive jurisdiction over any dispute not otherwise resolved, and you consent to venue there.
We may update these Terms from time to time. We'll post the updated version here and revise the "Last updated" date. Your continued use of the Site after changes means you accept them.
